By enrolling in the Hawaii Swimming Program you agree to to following:
The participant and/or parent/guardian agree that the enrolled participant and/or parent/guardian of the participant agree and understand that swimming is a hazardous activity.

The participant and/or parent/guardian recognizes there are risks inherent in the activity of swimming, including but not limited to paralyzing injuries and death.

The participant and/or parent/guardian hereby agrees to participate in Hawaii Swimming’s program and hereby agrees to indemnify and hold harmless Hawaii Swimming, Valley Isle Aquatics, Kelly E. Duell, Joseph A. Duran, Waikoloa Village Association, D & D Trust, its owners, directors, agents, and employees against any liability resulting from an injury that may occur to the participant while participating.

The participant and/or parent/guardian agrees to indemnify Hawaii Swimming, Valley Isle Aquatics, Kelly E. Duell, Joseph A. Duran, Waikoloa Village Association, or D & D Trust for any damages arising from claims, demand, action, or cause of action by the participant.

The participant and/or parent/guardian authorizes any representative of Hawaii Swimming, Valley Isle Aquatics, Kelly E. Duell, Joseph A. Duran, Waikoloa Village Association, or D & D Trust to have the participant treated in the case of a medical emergency during their participation. Further, the participant and/or parent/guardian agrees to pay all costs associated with the medical care and transportation of the participant.

The participant and/or parent/guardian understands that the participant and/or parent/guardian is required to put in writing any medical or health problems of which Kelly E. Duell and Joseph A. Duran should be aware.

The participant and/or parent/guardian have carefully read the pool rules specific to the facility

THE PARTICIPANT and/or PARENT/GUARDIAN HAS. CAREFULLY READ THE LIABILITY RELEASE AND AGREE WITH FULL KNOWLEDGE OF ITS CONTENTS AND SIGNIFICANCE.
